Terms of Sale

These terms govern your purchase of a domain name through SurfName.com. Read them before placing an order. When you submit the qualification form, you confirm that you have read and agree to these terms.

1. Who you are buying from

The seller of record is AVOSS DEVELOPMENT DBA SURFNAME.COM, a company registered in the Republic of Serbia. Our legal identification, registered address, and bank details appear in full on each invoice we issue. For day-to-day correspondence, write to domains@surfname.com.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. If you are placing the order on behalf of a company, you confirm that you are authorized to bind that company.

3. How an order is formed

Prices and product information shown on SurfName.com are an invitation to offer. When you submit the qualification form for a domain, you are making a binding offer to purchase that domain at the price shown.

We accept your offer when we issue the corresponding invoice (for bank-transfer orders) or when we open an Escrow.com transaction with you (for escrow orders). At that point a contract is formed.

We reserve the right to decline any order without giving a reason. Reasons we may decline include, but are not limited to: identity cannot be verified, stated intended use conflicts with third-party trademark rights, the listing has been sold or withdrawn between display and submission, or there are other reasonable grounds for concern.

4. Price and currency

Prices are shown in US dollars by default. EUR totals are computed at the European Central Bank reference rate on the order date and are locked on the invoice. No VAT is charged: this is an export of services under the Law on VAT of the Republic of Serbia.

The price covers transfer of the domain name to your nominated registrar. It does not cover any renewal fees at your registrar after transfer.

5. Payment

The default payment method is bank transfer against the invoice we issue. Payment is due within 5 business days of the invoice date. Unpaid orders may be cancelled after that window at our discretion and the listing returned to the marketplace.

Escrow.com is available on request. If you select escrow, the purchase price is the same but you also pay Escrow.com's fees to Escrow.com directly.

6. Transfer of the domain

Transfer of the domain name to your nominated registrar (for example Namecheap, GoDaddy, Cloudflare, Gandi, and others) begins right after your payment clears at our Raiffeisen Banka account. We will coordinate with you directly on authcode delivery, registrar handover, or push, whichever method your registrar supports.

Actual end-to-end completion depends on factors outside our control, including your registrar's processing time and any inter-registrar transfer window or lock imposed by ICANN or the TLD registry. We will keep you informed.

7. Warranties

We warrant that we own and have the right to transfer each domain listed until the moment it is marked sold. Domains are sold as-is; we make no representations or warranties as to SEO performance, historical traffic, backlinks, past use by prior owners, or suitability for any particular business purpose.

8. No withdrawal for performed digital services

Domain transfer is a digital service. By confirming the legal acknowledgement on the qualification form, you expressly consent to immediate performance of the transfer after payment clears, and you acknowledge that doing so eliminates any statutory right of withdrawal you might otherwise have (including, where applicable, the EU 14-day withdrawal right for distance contracts for digital content) once the transfer has been initiated.

9. Refunds

If the transfer cannot be completed through our fault, or if the domain turns out not to be transferable for reasons that existed at the time of sale, you will receive a full refund of the purchase price within 10 business days of us confirming that the transfer will not proceed.

Once the transfer has been successfully initiated at the registrar and the domain has moved (or auth codes have been delivered to you and accepted), the sale is final and no refunds are available.

10. Liability

To the maximum extent permitted by applicable law, our total aggregate liability in connection with any sale is limited to the purchase price paid for the domain in question. We are not liable for indirect, incidental, or consequential loss, including lost profits, lost business, lost goodwill, or business interruption.

Nothing in these terms limits or excludes our liability for fraud or for any other liability that cannot lawfully be limited or excluded.

11. Force majeure

We are not responsible for delays or failures in performance caused by events outside our reasonable control, including registry or registrar outages, DNS outages, ICANN policy changes, governmental action, natural disaster, or industrial action.

12. Data

Personal data you provide on the qualification form is processed as described in our Privacy Policy.

13. Governing law and jurisdiction

These terms are governed by the law of the Republic of Serbia. Disputes will be resolved in the courts of Novi Sad, Serbia, unless mandatory consumer protection rules of the buyer's country of habitual residence require otherwise.
